What is the EB-5 Visa?

The EB-5 is also known as an “investor visa” and can be issued to foreigners who wish to undertake business in the United States.

In addition to meeting a minimum financial contribution, the amount of which varies depending on the region in which the applicant plans to invest, it is crucial to demonstrate that the proposed venture will result in the creation of jobs and an improvement in the economic situation of the United States.

What are the investment requirements to qualify?

To qualify for the EB-5 visa, a foreign investor generally must make an investment of at least $1.8 million in a new U.S. business enterprise. However, if the investment is made in a Target Employment Area (TEA) or rural area, the minimum investment amount is reduced to $900,000.00

Job Creation: The investment must result in the creation of at least 10 full-time jobs in the US. These jobs can be direct or indirect, but they must be verifiable and sustainable.

Active Investment: The EB-5 investor must play an active role in the management of the venture in which he or she invested, unless he or she invested through a USCIS-approved regional center. Regional centers are entities that coordinate EB-5 investments in specific projects and can allow investors to take a more passive role in managing the business.

Eligibility: There are no specific age, education, or experience requirements to obtain an EB-5 visa. However, the investor must demonstrate that the funds invested were obtained legally.

Application Process: The application process involves filing an I-526 petition with the U.S. Citizenship and Immigration Services (USCIS). After this petition is approved, the investor and his family can apply for a conditional immigrant visa. Upon successful completion of the probation period (generally after two years), they can apply to have the status removed and obtain U.S. permanent resident status.

Beneficiaries: In addition to the primary investor, the investor's spouse and unmarried children under the age of 21 may be included in the application and receive EB-5 visas.

Annual Limitations: The US government sets an annual limit on the number of EB-5 visas available. This means there may be a waiting period depending on demand.
