What is the EB-2NIW VISA?
The EB-2NIW (National Interest Waiver) is a visa that allows the applicant to obtain permanent residence in the United States (green card) without having a job offer from an American employer.
For this visa category, the analysis is based on the applicant’s academic and professional qualifications and, in addition, it must be demonstrated how the applicant wishes to advance their career in the United States.
Another advantage of the EB-2NIW visa is that, since 2022, it has premium processing. In other words, by paying an additional fee of US$2,500.00 to the Immigration Department (USCIS), you can reduce the time for analyzing your petition to just 45 days. This way, you don’t have to wait months and months to get an answer.
ADVANCED ACADEMIC DEGREE OR SPECIAL SKILLS?
Through the EB-2NIW visa, the applicant must prove that they have an Advanced Academic Degree, that is, a degree higher than a bachelor’s degree (master’s, doctorate or PhD, for example).
If you do not have an advanced degree, the person can only have an academic diploma equivalent to a bachelor’s degree, as long as they have at least five years of progressive experience (after graduation) in their field of activity.
If the person does not qualify for the Advanced Academic Degree category, we have the Exceptional Skills category. To qualify as an Exceptional Skills professional, the applicant must meet three of the six criteria required by USCIS (U.S. Citizenship and Immigration Services):
Official Academic Record proving that the applicant has a diploma or certificates related to the area of exceptional skill;
Letters from current or former employers confirming at least 10 years of full-time experience in your field;
A license or certification to practice the profession;
Proof that the applicant receives a salary or other remuneration above average compared to other professionals in their field of activity;
Proof of membership in professional associations related to your area of activity;
Evidence of recognition for your achievements and significant contributions in your field.
