Professionals with “extraordinary abilities” are those who stand out and have broad national or international recognition in the arts, education, science, business or athletics. A major difference with the EB-1 visa is that it does not require a job offer or employer for the applicant, as the applicant is qualified only on the basis of his or her merits and professional trajectory.
REQUIREMENTS FOR EXTRAORDINARY ABILITIES:
For these professionals, it is necessary to demonstrate international recognition for extraordinary achievements in their academic fields and a minimum of 3 years of teaching or research experience in their academic field.
They must also be immigrating to the United States to continue their studies or hold prominent research positions at an institution of higher education.
The applicant must present careful documentation and a job offer from an employer in the United States.
For this visa, the professional must be an executive who has managerial capacity and must be immigrating to the United States in that capacity for the same company, affiliate or subsidiary.
As minimum requirements, the professional must have worked for at least one year outside the United States with the same employer, with this work having been carried out in the three years prior to sending the petition.
