What is the EB-1 Visa?

Professionals with “extraordinary abilities” are those who stand out and have broad national or international recognition in the arts, education, science, business or athletics. A major difference with the EB-1 visa is that it does not require a job offer or employer for the applicant, as the applicant is qualified only on the basis of his or her merits and professional trajectory.

To qualify for an EB-1 visa, an applicant must meet at least 3 of the 10 items below:

REQUIREMENTS FOR EXTRAORDINARY ABILITIES:

Evidence of receiving awards and national or international recognition for excellence in your profession.

Evidence of your participation in professional associations that require extraordinary achievements or qualifications from their members.

Evidence of your participation in professional associations that require extraordinary achievements or qualifications from their members.

Evidence that you were invited to judge other people's work, individually or were part of an evaluation panel.

Evidence of your scientific, academic, artistic, athletic, or business-related contributions of great importance to the field.

Evidence of authorship of academic articles in professional commercial publications or other highly important media.

Evidence that your work has been displayed in exhibitions or art shows.

Evidence that you have played an essential or critical leadership role in distinguished organizations.

Evidence that you have a high salary in relation to other professionals in the same area.

Evidence of its commercial success in shows.

Requirements for extraordinary abilities

For these professionals, it is necessary to demonstrate international recognition for extraordinary achievements in their academic fields and a minimum of 3 years of teaching or research experience in their academic field.

They must also be immigrating to the United States to continue their studies or hold prominent research positions at an institution of higher education.

The applicant must present careful documentation and a job offer from an employer in the United States.

EB-1 FOR MANAGER OR EXECUTIVES OF MULTINATIONALS

For this visa, the professional must be an executive who has managerial capacity and must be immigrating to the United States in that capacity for the same company, affiliate or subsidiary.

As minimum requirements, the professional must have worked for at least one year outside the United States with the same employer, with this work having been carried out in the three years prior to sending the petition.
