What is the E2 Visa?

The E2 Visa is a United States non-immigrant visa intended for foreign investors who wish to invest a significant amount of capital in a U.S. business.

Investor Eligibility: To qualify for the E2 visa, the applicant must be a citizen of a country that has a commerce and navigation treaty with the United States. Many countries have these treaties, but eligibility can vary.

Substantial Investment: The applicant must invest a substantial amount of capital in a US business. There is no minimum amount established, but the investment must be significant enough to guarantee the success and operation of the business. The investment must be "at risky", meaning the applicant must be committed to the success of the business and have capital at risk.

Control and Direction: The applicant must actively control the U.S. business and have a directing role in its operation. This means that investors must be involved in the day-to-day running of the company.

Business Type: The E2 Visa is generally aimed at investors in active businesses, such as manufacturing, retail, services, technology companies, among others. It is less common for real estate or speculative investments.

Job: The deal is expected to create jobs for workers in the US. However, there is no specific number of jobs established, and the amount required may vary depending on the type of business and investment.

Renovation: E2 visa holders can initially stay in the US for up to 2 years, with possible extensions. The E-2 visa can be renewed as long as the business continues to operate and meets the visa requirements.

Spouse and Children: The E2 visa holder's spouse and children under 21 can accompany him or her to the U.S. on dependent E2 visas. Spouses can apply for work authorization in the United States.

Commerce and Navigation Treaties: It is important to check whether the investor's country of origin has a trade and navigation treaty with the USA, as this is a fundamental condition for eligibility.

The E2 visa is an attractive option for foreign investors who want to operate businesses in the United States. However, the requirements are specific, and detailed documentation is required to demonstrate eligibility. Furthermore, the E-2 visa is temporary in nature and does not automatically lead to obtaining a Green Card (permanent residence).
